Interpretation

The Company – Freemans Fuel’s/Parkview Service Station

 The Seller - this means Freemans Fuel’s or its successors, assignees, sub-contractors and authorised agents acting within the terms of their agency agreement

The Buyer – this means to any person or persons, firm or firms, company or companies, who shall order or buy the Goods or Services

The Goods – this means to goods and/or material supplied or sold by the seller to the buyer in accordance with the terms of any individual contract

The Service – this means any services provided by the seller in accordance with the terms of any individual contract

The Driver – this means the individual delivering the service to the buyer on behalf of the seller

The Order/Order placed – this means any order placed for the good or the services

The Contract – this means the individual contract for the sale or supply of the good and/or service by the seller to the buyer; written or verbal

Conditions – this means the terms and conditions of the sale set out in this document together with any amendments from time to time

Reference to any statute or statutory provision includes a reference to that statute or statutory provision as from time to time amended, extended or re-enacted. Reference to any clause is to a clause of these conditions of sale.

Terms & Conditions of sale of goods and/or service from the Seller to the Buyer

Ownership of goods supplied shall pass only when payment has been received by the seller in full and not on delivery of goods

When you place an order online via website, a contract is formed between the buyer and the seller. The buyer will receive confirmation of this via email where a valid email address is supplied

When the buyer places a sales order by phone, a contract is formed between the buyer and the seller when the seller confirms on the phone that the order has been accepted

If the ordered volume does not fit in the buyer’s tank/container, the price will be readjusted accordingly as priced of date of order. A credit will be raised on the buyers account with the seller in necessary

The buyer is responsible for providing suitable storage and for ensuring that the tank will adequately hold the quantity ordered.  The buyer will compensate the seller against any damages or expenses acquired as a result of the buyer overlooking these conditions

It is the responsibility of the buyer that all measuring devices are in a secure state and fit for a fuel delivery

The seller shall not be responsible for failure to make deliveries if fulfilment has been delayed, hindered or prevented by circumstances which are out of the seller’s immediate control

The company (Freemans Fuel’s) does not accept the responsibility for the dipping, checking or testing of the buyer’s tank. The company can however offer advice on a third party to carry out these services.

The buyer should provide information about any special delivery conditions or requirements at the time the order is placed. This could include, without limitation, narrow access, constrained turning of delivery vehicles or a difficult access to or underground tank and/or access denied, for example, a locked gate\door to tank area.

The driver’s access to the delivery of goods and/or services should be clear of any Health Hazard which may interfere or endanger the driver making delivery, for example, excessive pet fouling. Should the buyer proceed with placing an order and these conditions have not been met the buyer may be charged by the seller for calling out the tanker

Any date or time specified by the Seller for delivery of the Goods is an estimate only. The Seller and Driver will make up most effort to deliver the goods and/or service at the estimated time, however, this could change in accordance to circumstances out of their control. For example, weather conditions and/or mechanical breakdown.

Deliveries will normally only be made to the buyer within the seller’s working hours and during the Seller’s working days (Monday to Friday), although the seller reserves the right to deliver outside of these times at their discretion. It is the buyer’s responsibility to make sure there is access to the tank/container within these times.

If a return of goods or refund is agreed between the buyer and the seller, the buyer’s credit will be amended within 3-5 working days.

Product Safety; in normal use, fuel is safe but please observe the following precautions:

  1. The product supplied is flammable and in the event of a fire, a CO2 foam or dry powder extinguisher should be used
  2. Do not use water in the event of the fire, as this could cause a spread
  3. Avoid handling the product. If splashed onto the eyes or swallowed immediately seek medical assistance
  4. Products supplied should be stored in a properly constructed, installed and maintained tank
